Who we are

Emerald Funding Solutions Limited (“Emerald”, “we”, “us”) provides lending services in Jamaica. Our registered address is 9th Floor, Panjam Building, 60 Knutsford Boulevard, New Kingston, Jamaica. We are responsible for the personal data described in this notice.

Information we collect

Depending on how you deal with us, we may collect:

• When you apply for a loan: your name, contact details, date of birth, identification details and documents, address and household information, employment and income information, details of the loan you request, supporting documents and next-of-kin details.
• When you contact us: your name, email address, phone number (if you give it) and your message, whether you use the contact form, email, phone or WhatsApp.
• If you have a client account: account, loan and repayment information, and your communications with us.
• When you visit this website: technical information such as your IP address, browser and device type, the pages you view and when, and security logs. Some of this is collected through cookies and similar technologies (see our Cookie Policy).

Why we use it

We use personal data to receive and assess loan applications; verify identity and application information; make lending and affordability decisions; administer loans and repayments; communicate with applicants and customers; prevent fraud and protect our services and website; comply with legal and regulatory obligations; handle enquiries and complaints; and understand and improve how our website is used.

Where the law requires a basis for this, we rely on one or more of the following: taking steps at your request before entering a loan agreement, or performing that agreement; meeting our legal and regulatory obligations; our legitimate interests in running, securing and improving our business, where these are not outweighed by your rights; and your consent, where we ask for it.

LoanBit and service providers

We use service providers to operate parts of our website and services. LoanBit, operated by PlainQode Software Limited, provides the technology platform used for online applications, the loan calculator, customer account access and loan-management functions. Other providers include:

• Microsoft, for our business email, including messages sent from our website forms;
• Google, for website analytics (Google Analytics), search performance reporting (Google Search Console) and fonts;
• Microsoft Bing, for search performance reporting;
• Cloudflare, for security and spam protection, including on our contact form;
• GoDaddy, which hosts this website; and
• Font Awesome, which supplies icons used on the website.

Service providers process personal data only for authorised purposes and are expected to protect it appropriately. If you choose to message us on WhatsApp, that conversation is also handled by WhatsApp under its own terms and privacy policy.

Sharing

We may disclose personal data to service providers and processors, professional advisers, payment and financial service providers, credit or identity-verification services where applicable, regulators and public authorities where required, and other recipients where authorised by law or by the individual. We do not sell personal data.

International processing

Some service providers, including those listed above, may process or store information outside Jamaica. Where this happens we will put appropriate safeguards in place.

Retention

We keep personal data only for as long as necessary for the purposes for which it was collected and to meet applicable legal, regulatory, accounting and dispute-resolution requirements. Loan application and account records are kept for the periods that the law requires. Website analytics data is kept for the period set in our analytics settings.

Security

We use appropriate technical and organisational measures designed to protect personal data against unauthorised or unlawful processing, accidental loss, destruction or damage. Our website uses encryption in transit and security monitoring. No online service can guarantee absolute security.

Your rights

Subject to the Data Protection Act, 2020, you may have the right to ask us for access to the personal data we hold about you, to have it corrected, to object to or ask us to restrict certain processing, and, where we rely on your consent, to withdraw that consent. Send requests to our Data Protection Officer at privacy@emeraldfundingsols.com. We may need to confirm your identity before we act on a request. If you are not satisfied with how we have handled your personal data, you may also complain to the Office of the Information Commissioner in Jamaica.

Cookies and analytics

This website uses cookies and similar technologies, including cookies that help us measure how the site is used. We ask for your choice about analytics cookies when you first visit, and you can change it at any time using Cookie settings in the footer. Our Cookie Policy explains what we use and how you can control it.

Children

Our services are for adults. We do not knowingly collect personal data from anyone under 18 through this website.

We may update this notice when our services, legal obligations or processing arrangements change. The date of the latest update is shown at the top of this page.
